About the EB-5 Investor Visa
The EB-5 Immigrant Investor Program is a U.S. government-regulated pathway that grants lawful permanent residency (Green Card) to foreign investors who:

- Make a qualifying investment in a new commercial enterprise in the U.S.
- Create or preserve at least 10 full-time jobs for American workers.

Eligibility Criteria
To qualify for the EB-5 program, applicants must meet the following criteria:

To apply for the EB-5 visa, you must invest:

Targeted Employment Area (TEA)
(rural area or area with high unemployment), or - USD $1,050,000 — for projects outside TEA zones

The investment must be made into a new commercial enterprise (NCE) that is:

- A for-profit business
- Established after November 29, 1990, or significantly restructured if older
- Capable of creating 10+ qualifying full-time jobs
2. Job Creation Requirements
Your investment must directly or indirectly lead to the creation of:

- 10 full-time jobs for lawful U.S. workers
- Jobs must be sustained for a minimum of 2 years
- Regional Center investments may count indirect and induced jobs, making job creation easier to fulfill
3. Source of Funds Requirements
Investors must prove that all investment funds were obtained lawfully, such as through:

- Salary or business income
- Property sales
- Inheritance
- Gifts
- Investments or dividends
- Other legal financial sources
Complete financial documentation is required.
4. Character & Medical Requirements

Pathway to U.S. Permanent Residency

The EB-5 visa provides:

- Conditional Permanent Residency for 2 years
- After proving job creation → full 10-year Green Card

Step-by-Step Guide
Step 1
Choose an Investment Project

Prepare Source-of-Funds & File Form

- Submit the immigrant petition for the EB-5 program.

Step 3
Conditional Green Card Approval
Once I-526E is approved:
- If inside the U.S.: File I-485 (Adjustment of Status)
- If outside the U.S.: Attend the U.S. Embassy interview
Receive a Conditional Green Card, valid for 2 years.
Step 4
Prove Job Creation & File Form I-829
- File I-829 to remove conditions.
- Must show full investment and creation of 10 jobs
Outcome:
- Receive 10-year Permanent Resident Card
- Renewable every 10 years
- Eligible for citizenship after 5 years of residency
